The lawsuit claims OpenAI engaged in a “deeply troubling pattern” of hiring former xAI employees. These employees allegedly had access to trade secrets related to xAI’s Grok AI chatbot.
According to the filing, OpenAI targeted workers with specific knowledge of xAI’s technologies and business plans. The company allegedly sought employees who knew about xAI’s source code and operational advantages in launching data centers.
xAI states that OpenAI induced these employees to break their confidentiality agreements through unlawful means. The complaint describes this as a systematic campaign to undermine xAI’s competitive position.
The trade secret allegations emerged during xAI’s investigation of former engineer Xuechen Li. xAI has accused Li of taking confidential information to OpenAI in a separate lawsuit.
Targeted Employee Recruitment
The lawsuit identifies three former xAI employees who joined OpenAI. These include engineer Xuechen Li, engineer Jimmy Fraiture, and an unnamed senior finance executive.

Expanding Legal Battle
This lawsuit represents the latest development in ongoing legal disputes between Musk and OpenAI. Musk co-founded OpenAI but left the company’s board in 2018.
xAI has also filed a separate lawsuit against Apple in federal court. That case alleges Apple conspired with OpenAI to suppress rival AI platforms.
Musk is separately suing OpenAI over its conversion from a nonprofit to a for-profit company. OpenAI has countersued Musk for harassment in response.
