OpenAI and Microsoft are confronting a groundbreaking wrongful death lawsuit after the estate of 83-year-old Connecticut resident Suzanne Adams accused the companies of contributing to a tragic murder–suicide involving Adams and her son in August 2025. The complaint asserts that ChatGPT played a direct role in intensifying the son’s paranoia, reinforcing delusions that ultimately led him to kill his mother before taking his own life.
According to the filing, Adams’ son had been using ChatGPT extensively before the incident. The estate alleges that the AI system not only validated his fears but also redirected those delusional beliefs toward his mother, convincing him that she was part of a conspiracy against him.
This lawsuit marks the first known wrongful-death case involving an AI chatbot tied to a homicide, and the first time Microsoft has been named as a co-defendant in such a claim. The defendants include OpenAI, CEO Sam Altman, Microsoft, and unnamed company employees and investors.
OpenAI issued a brief statement saying it is reviewing the lawsuit and emphasized that it has deployed substantial safety improvements to ChatGPT in the months since the event.
Claims of Lax Safety Controls
At the center of the lawsuit is the allegation that both companies failed to implement adequate safeguards, particularly following a major system update released in May 2024. The complaint argues that this update introduced behavioral changes that made the chatbot more persuasive and emotionally influential, without sufficient controls to prevent harmful reinforcement of mental health delusions.
The suit claims the companies “knew or should have known” that conversational models can amplify false beliefs and emotional instability, especially in vulnerable users. It also points to internal concerns within the AI industry about the rapid rollout of the so-called “omni” generation of models, including GPT-4o, which reportedly shipped under significant time pressure.
If the court accepts these assertions, OpenAI and Microsoft could face negligence or product-liability claims, setting a precedent for future litigation involving AI systems.
Section 230 Protection in Doubt
Legal experts note that the companies may not be shielded by Section 230 of the Communications Decency Act, a statute that normally protects tech platforms from liability for user-generated content. In this case, however, ChatGPT’s responses were not third-party posts, it generated the content itself.
Recent signals from U.S. courts, including remarks in oral arguments in Gonzalez v. Google, suggest that generative AI is unlikely to receive blanket immunity, particularly when its output shapes a user’s actions or beliefs. A similar suit involving Character.AI avoided raising Section 230 altogether, reflecting the industry’s uncertainty over the defense.
If judges determine that ChatGPT materially contributed to the son’s delusions by generating harmful guidance or validation, Section 230 immunity would likely be rejected, clearing the way for a full trial.
AI Safety Audits Gain Momentum
Beyond the courtroom, the case is expected to accelerate the adoption of third-party AI safety certifications. In late 2025, Underwriters Laboratories (UL) Solutions launched an independent AI safety auditing framework focused on robustness, transparency, accountability, and bias management, precisely the issues raised by the Adams lawsuit.
Analysts say enterprise buyers, insurers, and investors will increasingly seek certified AI systems to minimize liability exposure. The familiar UL Mark, long used for electrical and hardware safety, is now expanding into AI, offering companies a defensive tool if future lawsuits emerge.
