- County election boards must authenticate the signatures before the state’s top election official can approve the ballot measures.
- If approved, the framework would permit up to 10 digital sportsbook operators connected to Nebraska’s existing casino properties.
- The initiative receives financial support from WarHorse Casinos and major operators like DraftKings, FanDuel, and others through the Sports Betting Alliance.
Residents of Nebraska could have the opportunity to vote on legalizing mobile sports wagering when they head to the polls this November.
Campaign organizers collected approximately 350,000 signatures through two distinct petition efforts. This figure significantly exceeds the state’s legal requirements for ballot placement.
Tax Relief Nebraska, the organization spearheading the initiative, delivered more than 201,000 signatures supporting a constitutional amendment.
Additionally, the group provided approximately 146,000 signatures for a complementary legislative measure. This secondary petition would establish the regulatory framework for digital sports betting operations.
The constitutional change required roughly 126,000 verified signatures for qualification. The legislative component needed approximately 88,000 valid signatures.
Local election administrators will now authenticate the submitted signatures. Following this verification, Secretary of State Robert Evnen will determine whether both measures meet the standards for ballot inclusion.
Currently, Nebraska permits sports wagering only at physical locations. Bettors must travel to one of the state’s authorized casino facilities to participate.
Structure of the Proposed System
Under the proposed framework, each authorized casino property could establish partnerships with up to two digital betting platforms. All mobile wagering activity would be processed through servers physically located within Nebraska’s borders.
With five licensed retail sportsbooks currently operating in Nebraska, the proposal could result in up to 10 mobile betting platforms serving the state.
The Nebraska Racing and Gaming Commission would be tasked with developing comprehensive regulations by June 1, 2027. Should voters approve the initiative, implementation would begin on January 1, 2027.
Revenue generated through online betting taxation would primarily fund property tax reduction efforts. The statutory provision allocates 70 percent toward this purpose, aligning with the existing distribution model for casino tax collections.
State legislators attempted to enact comparable regulations during the current year’s session through two separate bills. Both legislative efforts ultimately failed to advance.
This legislative setback prompted advocates to pursue the ballot initiative route instead. Missouri employed an identical strategy in 2024, successfully gaining voter approval.
Financial Backers and Campaign Strategy
WarHorse Casinos and the Sports Betting Alliance are providing financial resources for the petition campaign. The Alliance comprises major industry players including FanDuel, DraftKings, BetMGM, Fanatics, and bet365.
According to a WarHorse government relations representative, the campaign encountered minimal resistance after signature collectors could clarify how their initiative differed from other concurrent petition drives.
The campaign now awaits completion of the signature authentication process. WarHorse representatives have indicated their intention to collaborate with DraftKings and FanDuel should voters approve the measure.
Proponents argue that Nebraska is forfeiting wagering revenue to surrounding jurisdictions. Colorado, Iowa, Kansas, Missouri, and Wyoming have already legalized mobile sports betting platforms.
Critics express concerns regarding gambling addiction risks associated with easy mobile betting access. They additionally question whether anticipated tax revenue would justify potential social consequences.
County election officials throughout Nebraska have begun the signature verification process. An official determination regarding ballot placement is anticipated within the next several weeks.
