A legal challenge has been mounted against President Donald Trump concerning a premium Truth Social offering that provides subscribers with accelerated access to his social media communications, which may contain market-moving government declarations.
The legal complaint was submitted Wednesday by The Intercept and Freedom of the Press Foundation to the U.S. District Court in Manhattan. Named defendants include Trump, White House Deputy Chief of Staff Dan Scavino, presidential executive assistant Natalie Harp, and the Executive Office of the President.
Known as Truth API, this premium offering was introduced by Trump Media on August 1. The platform expedites delivery of content from Trump and prominent Truth Social users before public visibility.
Subscription fees range from $60,000 to $100,000 each month. Trump Media interim CEO Kevin McGurn disclosed that more than ten clients have entered agreements, with the majority being high-frequency trading operations.
Legal Arguments
The legal filing contends the platform breaches First Amendment protections by granting premium subscribers privileged access to presidential communications that could contain official governmental information. The argument emphasizes equal access rights for the public and media organizations.
Additionally, a Fifth Amendment challenge has been presented. The legal team asserts that governmental entities cannot monetize access to publicly available benefits. Both constitutional arguments await judicial review.
“Nothing could be more antithetical to the free, independent press than the president charging for early access to his public announcements,” said The Intercept Chief Legal Officer David Bralow.
Trump has utilized Truth Social for announcing trade policy decisions, international relations initiatives, administrative appointments, and defense operations. This timing advantage holds significant value for financial trading operations.
The legal filing additionally highlights Trump’s ownership interest in Trump Media. The Donald J. Trump Revocable Trust controls approximately 41.43% of company shares, with Trump designated as sole beneficiary. This stake has been assessed at exceeding $1 billion in value.
New Market Opportunities and Cryptocurrency Adjustments
Trump Media is currently exploring data licensing arrangements with prediction market platforms as an additional revenue channel. McGurn acknowledged the company’s assessment of prediction market opportunities while declining to specify which datasets would be commercialized.
Simultaneously, the company has reversed course on previous cryptocurrency initiatives. Trump Media and Crypto.com have canceled plans for a publicly traded CRO treasury entity and discontinued the exchange’s participation in proposed Truth.Fi exchange-traded fund products.
Trump Media disclosed $360.6 million in unrealized and additional accounting losses related to cryptocurrency holdings during the first six months of 2026.

The company’s cryptocurrency portfolio was assessed at $597.7 million on June 30. This portfolio comprises 9,477 Bitcoin valued at $557.1 million and 756.1 million CRO tokens valued at $40.6 million.
The lawsuit seeks a judicial determination declaring Truth API unconstitutional and mandating equal access to official presidential communications.
